A NEW TRIAL
Resources
On August 25, 2017 the Senior Resident Superior Court Judge Vance Bradford Long conducted a limited evidentiary hearing for the purpose of "determining if Defendant was to entitled to proceed" with claims ranging from the prosecution knowingly presenting and using false evidence to ineffective assistance of trial counsel.
That judge then ordered a continuation of that hearing but then without warning cancelled it and ruled that I WS to have no relief on the issues that he couldn't even bother to hear. That decision by him was appealed to the N.C. Supreme Court.
On August 13, 2021 the N.C. Supreme Court filed their ruling on that matter staying in their conclusion that, " We hold that the MAR court erred in summarily dismissing Allen's guilt-innocence phase IAC claims without an evidentiary hearing. Because Allen has presented evidence which, if proven true would entitle him to relief.. " .
The N.C. Supreme Court then remanded to the MAR court to conduct a new "full and fair" evidentiary hearing, the results of which are now posted here.
A more detailed explanation recounting events both inside that hearing and behind the scenes, is shortly forthcoming.

Court Transcript from December 2018 Annotated

Checking Statement of Chris G.'s Credit Card
Statement showing when and where the credit card was used after Chris G. was murdered. Security tapes showed people that remain unidentified to this day. Reports, if Vanessa S. was seen on the tapes vary. The tapes got damaged in police custody and are not available anymore.
Letter Unti 2014 - Surveillance Tapes
Letter to Scott by his attorney, Mr. Unti. Attached to the letter are some court transcripts in which surveillance tapes are being discussed. These tapes show the faces of people using an ATM machine during the time frame in which the victim's credit card was used. The tapes neither showed Vanessa nor Scott using the credit card (contrary to Vanessa's statement). We also get a glimpse in how evidence was mishandled by the police (the ATM tapes got lost in police custody).
